Terms of Service

1. About these Terms

These Terms of Service (“Terms”) govern your access to and use of the website operated by DataPatrons — the trade name of a sole proprietorship owned and operated by Ms. Karuna Kumari (“DataPatrons”, “we”, “us”, or “our”) — at https://datapatrons.com (“Site”).

By accessing or using the Site, you agree to these Terms. If you do not agree to these Terms, please do not use the Site.

These Terms apply only to use of the Site. They do not automatically govern paid consulting, engineering, development, AI, data, cloud, migration, automation, or other professional services provided by DataPatrons.

Any project-specific services are governed by separate written agreements, such as proposals, Statements of Work, Master Services Agreements, Non-Disclosure Agreements, purchase orders, or other client contracts.

2. Nature of the Site

The Site provides information about DataPatrons, our capabilities, our service areas, and ways to contact us.

The Site is currently a business information and lead-generation website. It does not currently provide:

• SaaS user accounts
• Consumer accounts
• Online subscriptions
• Online payment processing
• Public user-generated content features
• Marketplace services
• Self-service software access

Submitting an inquiry through the Site does not create a client relationship, partnership, employment relationship, joint venture, or obligation for DataPatrons to provide services.

3. Service inquiries and project agreements

You may use the Site to contact us about potential services. Any response from us is for discussion purposes only unless and until a separate written agreement is executed.

Project scope, deliverables, fees, timelines, acceptance criteria, confidentiality, data protection, intellectual property ownership, warranties, support obligations, and liability terms must be agreed separately in a written proposal, Statement of Work, Master Services Agreement, or other signed agreement.

If there is a conflict between these Terms and a signed project agreement, the signed project agreement will normally control for that specific project.

4. Acceptable use

You agree to use the Site only for lawful purposes and in a manner that does not harm DataPatrons, our systems, other users, or third parties.

You must not:

• Attempt to gain unauthorised access to the Site, systems, servers, networks, or data.
• Interfere with or disrupt the Site or its availability.
• Use automated scraping, crawling, bots, or excessive requests in a way that harms or burdens the Site.
• Upload, transmit, or introduce malware, malicious code, spam, or harmful content.
• Submit false, misleading, unlawful, confidential, infringing, or unauthorised information.
• Use the Site to violate any applicable law, regulation, intellectual property right, privacy right, or contractual obligation.
• Misrepresent your identity, authority, company affiliation, or purpose for contacting us.

You are responsible for ensuring that any information you submit through the Site is accurate, lawful, and authorised for sharing.

5. Contact form submissions

Our contact form currently asks for your name and email address and may optionally allow you to provide your company name and a message.

You should not submit sensitive personal information, confidential business information, trade secrets, passwords, API keys, source code, datasets, regulated data, financial information, or any information you are not authorised to share through the public contact form.

By submitting information through the Site, you confirm that you have the right to share that information and that DataPatrons may use it to review, respond to, and manage your inquiry in accordance with our Privacy Policy.

6. Intellectual property

Unless otherwise stated, all content on the Site, including text, graphics, logos, icons, layout, design, service descriptions, brand elements, and other materials, is owned by or licensed to DataPatrons.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable permission to access and view the Site for your own internal business evaluation purposes.

You may not, without our prior written consent:

• Copy, reproduce, republish, distribute, or publicly display substantial portions of the Site.
• Use DataPatrons’ name, logo, branding, or materials in a way that suggests endorsement, partnership, or affiliation.
• Modify, adapt, translate, reverse engineer, decompile, or attempt to extract source code from any Site component, except where permitted by law.
• Use Site content to train, benchmark, or build competing models, datasets, products, or services without permission.

Intellectual property rights in client project deliverables are governed by the applicable project agreement, not by these website Terms.

7. Third-party links and tools

The Site may include links to third-party websites, platforms, tools, social profiles, calendar tools, analytics services, embedded content, or other resources.

We do not control and are not responsible for third-party content, availability, security, privacy practices, or terms. Your use of third-party services is at your own risk and subject to their own terms and policies.

8. No professional advice through the Site

Content on the Site is provided for general business information only. It should not be treated as legal, financial, tax, regulatory, compliance, security, or professional advice for your specific circumstances.

Technology, AI, data, cloud, migration, and software engineering decisions can involve significant business, legal, security, regulatory, and operational considerations. You should seek appropriate professional advice before relying on any general information from the Site.

9. No guarantees from website content

We aim to keep the Site accurate, useful, and up to date, but we do not guarantee that any content on the Site is complete, current, error-free, or suitable for your specific needs.

Any examples, case studies, service descriptions, estimates, timelines, or capability statements on the Site are general in nature. They do not guarantee that the same outcome, timeline, cost, architecture, or result will apply to your project.

Specific commitments are made only in written project agreements signed or accepted by the relevant parties.

10. Website availability and security

The Site is provided on an “as is” and “as available” basis.

We do not guarantee that the Site will always be available, uninterrupted, secure, error-free, free from malware, or compatible with every browser, device, system, or configuration.

We may update, suspend, restrict, or discontinue any part of the Site at any time without notice.

11. Limitation of liability

The Site is provided to you free of charge and for general information only. To the fullest extent permitted by applicable law, DataPatrons will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the Site.

This includes, without limitation, loss of profits, revenue, business opportunity, goodwill, data, or business interruption, even if we were advised of the possibility of such losses.

Because access to the Site is provided free of charge, to the fullest extent permitted by applicable law, DataPatrons’ total aggregate liability for all claims arising from or related to use of the Site shall not exceed INR 10,000 (ten thousand Indian Rupees), or the amount (if any) you actually paid us to access the Site, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, or other liability that applicable law does not permit to be excluded.

12. Indemnity

You agree to indemnify and hold DataPatrons harmless from reasonable losses, claims, damages, liabilities, costs, and expenses arising from your misuse of the Site, your violation of these Terms, your violation of applicable law, or your submission of information that infringes or violates the rights of another person or entity.

This indemnity does not make you responsible for DataPatrons’ own non-delegable legal obligations.

13. Privacy

Our Privacy Policy explains how we collect, use, store, and protect personal information when you use the Site or contact us. Please review our Privacy Policy.

14. Changes to these Terms

We may update these Terms from time to time to reflect changes in our Site, services, business operations, or applicable law.

When we update these Terms, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after updated Terms are posted means you accept the updated Terms.

15. Governing law and jurisdiction

Unless otherwise agreed in a signed client contract, these Terms and any dispute arising from or relating to the Site are governed by the laws of India.

Subject to any mandatory rights you may have under applicable law, the courts of Gautam Buddha Nagar (Greater Noida), Uttar Pradesh, India will have jurisdiction over disputes relating to these Terms or use of the Site.
